On the occasion of the 12th National Assembly elections, after the submission of nomination papers, the fate of 2 thousand 712 candidates in 300 constituencies of the country is being scrutinized, which will continue till Monday (December 4).

After the submission of nomination papers on Thursday (November 30), the scrutiny process started from Friday (December 1). But for what reasons can candidature in the election be cancelled; Let's find out.

According to the constitution certain conditions have to be fulfilled for a person to be elected. According to clauses 1 and 2 of article 66 of the constitution, a candidate must be a citizen of Bangladesh and must be above 25 years of age to stand for election. In addition, the code of conduct must be followed; Required information must be provided. They will be scrutinized and determined for eligibility.

declared unnatural:

If a person is declared 'unnatural' by the court, he cannot be a candidate in the National Assembly elections.

Loyalty to foreign states:

A person who is a citizen of or professes allegiance to a foreign country shall be disqualified as a candidate.

collateral:

At the time of submitting the nomination paper, the candidate has to deposit a certain amount of money to the Election Commission (EC) as security. If a person does not give the specified amount as security along with the nomination paper, his/her candidature will be canceled at the stage of verification.

Deficiency of information in affidavit:

Candidate's Name, Parents' Name, National Identity Card Number, Proposer's Name, Supporter's Name, Proposer's and Supporter's Signature along with Nomination Paper, whether he has duly filled in the Affidavit, whether there is any criminal case against the candidate and the immovable and immovable of the candidate and his family members. Property details are to be attached. If these 8 details are not provided correctly along with the affidavit, the candidature may be rejected. However, the Returning Officer does not cancel the candidature for minor errors like incorrect voter number of the supporter. In that case, the person who submitted the nomination is given an opportunity to make corrections. Apart from this, the income tax certificate must be submitted along with the nomination form. Failure to do so may result in cancellation of nomination papers.

Debt and bill default:

If a person defaults, gets sentenced or has outstanding utility bills, his nomination will be cancelled. For example, if a person is convicted of a criminal offense for moral turpitude and sentenced to imprisonment for at least two years, he cannot be a candidate for a period of five years after serving the sentence. Apart from this, if the person is a bank defaulter, he cannot be a candidate until he is discharged and if any kind of bill is outstanding, that person cannot be a candidate.

wrong information:

To submit nomination papers as an independent candidate, he has to follow special rules. If a person submitting nomination as an independent candidate has been elected before, he only needs to submit gazette. But if he comes to the election for the first time, he will have to submit the supporting signatures of one percent of the total voters of that area. That is, if there are three lakh voters in an area, the supporting signatures of three thousand voters must be submitted. If less than this, the nomination will be cancelled. Any 10 names are given against 10 serial numbers during verification of those whose supporting signatures are submitted. If none of them is found or the person whose signature is taken refuses to sign, the candidature of the person who submitted the nomination paper will be cancelled.

Violation of code of conduct:

According to the rules, there are several rules, from putting up posters on the walls of the candidate, giving money to the voters or not respecting the level playing field. If a candidate does not follow these points, the EC may cancel his/her candidature.

Actions to be taken in case of cancellation of candidature:

After the verification process, if the returning officer cancels the candidature of someone, the person who does not get the nomination within the specified time can apply to the Election Commission for his remedy. Even there, if the result goes against him, he can go to the final election tribunal. The court is open to him even though the EC has declared the gazette to cancel the candidacy. The same applies even after becoming a candidate. In that case the candidature is not canceled in the first place. Be warned first. Then mourning is done.
